These Terms and Conditions (“Terms”) apply to the Site, including all its divisions, subsidiaries, and affiliated Internet sites that reference these Terms. The website is owned and operated by Captain Steve’s Swamp Buggy Adventures. Throughout the Site, the terms “we”, “us”, and “our” refer to Captain Steve’s Swamp Buggy Adventures. By accessing or using any part of the Site, you agree to be bound by these Terms of Service, including any additional terms and policies referenced herein and available by hyperlink.

Please read these Terms carefully. If you do not agree to all the terms and conditions of this agreement, you may not use the Site. If these Terms are considered an offer, acceptance is expressly limited to these Terms.

“We”, “Us”, “Our”, “Company”, and “Captain Steve’s Swamp Buggy Adventures” refer to Captain Steve’s Swamp Buggy Adventures.
“Terms” refers to all the terms and conditions listed in this Agreement.
“Products or Services” refers to the tour services or other offerings on Captain Steve’s Swamp Buggy Adventures Site.
“Customer” means any person or entity accessing the Site and accepting these Terms.
All transactions between you and Captain Steve’s Swamp Buggy Adventures are governed by these Terms.

About Captain Steve’s Swamp Buggy Adventures

Captain Steve’s Swamp Buggy Adventures offers unique swamp buggy tours led by fifth and sixth-generation Glades-men. Our rides accommodate up to six passengers per buggy, using the same buggies we use for hunting. All guidance provided as part of our Services is solely for informational purposes; you are free to decide whether or not to follow it.

Changes to the Terms of Use

We reserve the right to change, modify, or remove portions of these Terms at any time. Changes will be effective when posted on the Site. Your continued use of the Site following such changes constitutes acceptance of those changes. Please check this page periodically for updates.

Your Privacy

Our Privacy Policy governs how we collect and use your personal information. These Terms must be read in conjunction with our Privacy Policy.

What We Do

Captain Steve’s Swamp Buggy Adventures provides guided swamp buggy tours in the Florida Everglades. We offer same-day bookings based on availability, and you can check our workers’ availability when finalizing your booking. Once your booking is confirmed, a Contract Agreement is established between you and us.

Modifications to the Service and Prices

Prices are subject to change without notice. We reserve the right to modify or discontinue our services without liability to you or any third party. Any price change will be posted on the Site.

Booking and Payment

Booking: Tours require a minimum of 24 hours’ notice for formal booking. If you need a booking in less than 24 hours, please contact us directly at 239-695-2186.
Payment: Payments are securely processed through credit cards, debit cards, or Google Pay. Your payment will be held securely until the service is completed.

Refund and Cancellation Policy

We understand that plans can change, and we want to accommodate our customers as best we can. Our cancellation policy is as follows:

  • 30+ Days Before Your Tour: 100% refund.
  • 21-29 Days Before Your Tour: 90% refund or reschedule.
  • 14-20 Days Before Your Tour: 80% refund or reschedule.
  • 8-13 Days Before Your Tour: 50% refund or reschedule.
  • 1-7 Days Before Your Tour: No refund, reschedule only.
  • Hurricanes and Other Force Majeure Events: If your tour is affected by weather, natural disasters, or other force majeure events (including hurricanes), you may be eligible for a full refund or reschedule. Please note that we do not guarantee weather conditions or other uncontrollable circumstances and are not liable for such events. In the case of a hurricane, refunds will not be required unless the tour is canceled by us.

  • Weather-Related Cancellations by Customer

    If you cancel your tour due to weather conditions that affect your personal plans but not the operation of Captain Steve’s Swamp Buggy Adventures, we are unable to offer a refund. Our cancellation policy remains in effect, and we cannot be held liable for weather-related changes that do not directly affect our ability to operate. However, you may reschedule your tour based on availability.

Waiver

Failure by Captain Steve’s Swamp Buggy Adventures to enforce any part of these Terms does not waive our right to enforce them in the future.

Severability

If any part of these Terms is held to be invalid or unenforceable, it will be severed from these Terms without affecting the validity of the remaining provisions.

Modifications to These Terms

We may modify or discontinue the services described in these Terms at any time, with or without notice. Changes will be effective immediately upon posting. Continued use of the services constitutes acceptance of the updated Terms.

Disclaimer of Warranties

You agree to use our services at your own risk. The services are provided “as is” and “as available,” without any warranties, express or implied. We do not guarantee that the services will be uninterrupted or free from errors.

Limitation of Liability

To the maximum extent permitted by law, Captain Steve’s Swamp Buggy Adventures and its affiliates, officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

  1. Use or Inability to Use the Services: Including delays, interruptions, or errors in the service.
  2. Unauthorized Access: To or use of your data or personal information.
  3. Events Beyond Our Control: Including but not limited to natural disasters, equipment failure, or force majeure events.
  4. Customer’s Actions or Inactions: Including failure to follow safety instructions or guidelines provided during the tour.

In no event shall Captain Steve’s Swamp Buggy Adventures’ total liability to you for all claims exceed the amount paid by you for the specific tour or service in question.

This limitation of liability applies regardless of the legal theory under which such damages are sought and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify and hold Captain Steve’s Swamp Buggy Adventures harmless from any claims, losses, or damages resulting from your breach of these Terms.

Prohibited Uses

You are prohibited from using the services for illegal or harmful purposes, including but not limited to the use of malware, reverse engineering, or unauthorized distribution of the services.

Termination

By Us: We may suspend or terminate access to the services at any time, for any reason, without notice.
By You: You may terminate these Terms at any time by canceling your account or stopping use of the services.
Termination will not affect accrued rights or obligations.

General Legal Terms

Assignment: We may assign these Terms without your consent. You may not assign these Terms without our prior written consent.
Severability: If any part of these Terms is invalid, the remainder will remain in effect.
Relationship: These Terms create an independent contractor relationship, not an agency, joint venture, or partnership.
Entire Agreement: These Terms constitute the entire agreement between us and supersede any prior agreements.
